Divorce in California: The Basics

  • No-Fault Divorce
    California is a no-fault state. Most divorces are filed based on “irreconcilable differences,” meaning neither party has to prove wrongdoing.
  • Residency Requirements
    To file in California, at least one spouse must have lived in the state for 6 months and in the county of filing for 3 months.
  • The Process
  1. Petition Filed: One spouse files for divorce or legal separation.
  2. Service: The other spouse is formally served.
  3. Financial Disclosures: Both parties must provide complete and accurate disclosures of assets, debts, income, and expenses.
  4. Negotiation/Settlement: Many cases are resolved through settlement agreements.
  5. Trial: If agreements cannot be reached, the case proceeds to trial for a judge to decide.
  • Timeline
    The earliest a divorce can be finalized is
    six months and one day from the date the petition is served, though most cases take longer depending on complexity and conflict.

  • Divorce legally ends the marriage.
  • Legal separation keeps the marriage intact but resolves custody, support, and property issues — often chosen for religious, financial, or insurance reasons.
